Possession of Alcohol, Drugs, or Tobacco Products

Alcohol

Alcoholic includes any beverage containing .05% or more of alcohol by volume.
It cannot be possessed by anyone under the age of 21. Beverages with an alcohol content less than .05%
by volume, such as nonalcoholic beer, cannot be possessed by anyone under the age of 18 (MCL 750.28.

Drug Possession or Use

A student shall not possess or use drug related paraphernalia; nor (with the exception of possession and use of drugs prescribed for the student) shall a student possess, use, manufacture or be under any degree of influence whatsoever of any drugs, narcotics, marijuana, hallucinogens, stimulants, depressants or other controlled substance or counterfeit substance, “designer drugs” or controlled substance analogue intended for human use MCL 333.7201 – MCL. 333.7231.

Tobacco Products

It is a misdemeanor for anyone under the age of 18 to possess tobacco products.
Tobacco products include: cigarettes, cigars, chewing tobacco,
tobacco snuff, pipe tobacco or tobacco in any form, vape device, vape liquid, electronic cigarette and/or related device.

Administrator’s Responsibilities

  • Identify the problem and bring the student to the office.
  • Inform the student of what is suspected.
  • If possible, take possession of any alcohol/tobacco and personal property, e.g. book bag, purse, etc.
  • If an alcohol/drug/tobacco product is found or usage has been witnessed, call the local police (nonemergency).
  • Do not leave the student(s)/property unattended until assistance arrives.
  • Notify the parent/guardian.
  • Call Director of Student Services.

Staff’s Responsibilities

Notify the Administrator-in-Charge of any knowledge/information regarding:

  • • Alcohol consumption
  • Alcohol possession
  • Drug possession/use
  • Tobacco Possession/possession
  • Identify the student(s)
  • If possible, take possession of any alcohol/tobacco and personal property, e.g. book bag, purse, etc
  • Do not leave the student(s)/property unattended until assistance arrives

Drug Posession or Sale

Administrator’s Responsibilities

Secure the drug, but do not touch it.
Note: There may be additional drugs in locker(s) or vehicle(s).

Administrator’s Responsibilities:

If Drugs Are Found

  • Call the local police (non-emergency) for confiscation and disposal.
  • Call Central Office.
  • Take possession of any personal property, e.g. book bag, purse, etc.
  • Escort the student(s) to the office.
  • Do not leave the student(s) or property unattended.
  • Follow search and seizure guidelines.
  • Assist the police with any search.

If Drug Possession/Sale Is Suspected

  • Identify the problem/evaluate the situation and assess the credibility of the information.
  • Determine if reasonable suspicion exists to search.
  • Continue with above procedures.

Staff’s Responsibilities

Notify the Administrator-in-Charge ASAP if you have knowledge of or any information regarding:

  • A Drug Sale
  • Drug Possession
  • Drug Use
  • Identify the student(s)
  • If possible, take possession of any drug and personal property, e.g. book bag, purse, etc
  • Do not leave the student(s)/property unattended until assistance arrives.
